Conditions for use of the service

The terms and conditions for use of the XBMS service are presented below. This document is an agreement between the XBMS.EU service and XBMS.PL service publisher, hereafter referred to as the XBMS service and all Users operating the service. The Regulations constitute the legal basis for defining the terms of use the XBMS service. By visiting our service, the User accepts the current provisions of these Regulations of the service use and agrees to comply with all the rules contained herein. Our Privacy Policy supplements the Regulations. All rights not available in the Regulations are reserved.

Nature and purposes of the XBMS service

The XBMS Service is the information and promotional service owned by Quantum Controls Sp. z o.o. In accordance with this assumption, the service purposes are:

  1. Promotion of services and products of Quantum Controls for server software to monitoring systems of facilities infrastructure and complementary components;
  2. Making documentation of eQuest technology and the servers of the family XBMS available to the users;
  3. Gathering designers and integrators in order to share experiences, achievements and technical support in the field of Building Management System and Security Management System.

User registration and data protection

  1. Access to the documentation on the XBMS service is varied. You can only be a guest visiting us, as well as a registered user.
  2. Registration allows access the documentation resources located on the XBMS service. After registering, you can download files and receive our newsletter.
  3. Data provided during the registration process and other personal data, which can be gathered from the users when using the XBMS service, are gathered and used in accordance with the principles set forth in our Privacy Policy and the Law on the protection of personal data.
  4. The User, who logged into the XBMS service, can provide a request to delete it at any time. Account deleting is irreversible and means all users’ data removal.

Data protection

  1. The User who has account in the XBMS service is required to protect the confidentiality of passwords and user's names.
  2. The User is responsible for providing password and allowing use of his/her account by a third party.
  3. The User is required to immediately notify the XBMS service about use of the account by unauthorized persons or any other breach of security.

Limitation of Liability

The Publisher of the XBMS service is not liable for any results of the User's use of information or material obtained through the XBMS service (including any damages resulting from loss of profits or revenue, loss of possibility to use the service) to the maximum extent permitted by the applicable law, even in the event that the publisher of the XBMS service has been informed of the possibility of such damages.


  1. In the event of a claim for damages, irrespective of the legal basis of such claims, the publisher's liability shall be limited to the maximum extent permitted by the applicable law.

Disputes settlement

  1. The Regulations to use the page is subject to the Polish law, thus any dispute which may arise from implementation of the obligations contained herein shall be settled by the court of law in Poland.
  2. In the event that any provision of the Regulations is found to be inconsistent with the law of the competent court, the decision of the Court does not repeal other provisions of the Regulations and as a result all other provisions shall be valid.

Changes to the Regulations

The Publisher reserves the exclusive right to make changes in the XBMS.EU service and the XBMS.PL service at any time without the need to inform the users. The Users are responsible for regularly reviewing the Regulations and conditions, and use of the website following the changes means acceptance of implemented changes.
